We are not all lawyers, but we work together to support the legal profession and ensure a just society for all.The Litigation Solicitor takes instructions from the Council of the Law Society and undertakes litigation on behalf of the Council in the exercise of its protective function.  Critical to the regulatory function of the Law Society of New South Wales, this role also undertakes investigations into queries and allegations regarding persons who may have engaged in unqualified legal practice and/or held themselves or other entities out as entitled to engage in legal practice.  The incumbent must exercise judgment, set priorities, and schedule work to meet deadlines, at all times adopting the standards of the model litigant.ResponsibilitiesConducts litigation before the NSW Civil and Administrative Tribunal, the Supreme Court, the Court of Appeal, and other courts on behalf of the Council.Specifically, prepares for and appears in proceedings before the Courts and the Tribunal, including drafting, settling and filing Applications and other initiating processes, subpoenae and summonses, evidence and Instruments of Consent, receivership orders; researches relevant legislation and cases, prepares submissions, briefs counsel when approved, marshals witnesses, and completes itemised bills for recovery of costs.Investigates notifications of unqualified legal practice.  Takes action to ensure unqualified legal practice ceases either by compliance with given undertakings by the lay person, injunction or prosecution under the legislation.Prepares responses to subpoenae and summonses served on the Law Society and appears on return dates.Peruses, analyses and masters facts and issues in external interveners' reports, Council's instructions, and counsel's advice.Provides advice to professional staff in the Professional Standards Department in respect of the conduct of investigations, gathering of evidence, and preparation and conduct of matters referred for litigation.Assists generally in the performance of duties by solicitors of the Professional Standards Department.Qualifications and relevant experience requiredAdmitted as a Legal Practitioner in NSW and currently holds an Unrestricted Practising Certificate.5+ years’ experience in private practice, more senior candidates are encouragedCivil litigation experience, ideally experience in regulatory litigationA specific knowledge and understanding of the Uniform Law, ancillary Acts and Rules, and relevant Court and Tribunal Acts and Rules, and can apply the same Demonstrated practical experience and the ability to identify a relevant breach of the law and litigating that breach with a view to protecting members of the public from similar breaches by other solicitors or lay associatesCan appropriately prioritise cases, gather and analyse the right information to identify issues; and identify, gather and adduce the most probative evidence to prove allegations.Can ascertain comprehensive details of the nature and scope of a complaint identified as a potential matter for litigationHighly developed interpersonal skills with a demonstrated ability of perspective, insight and judgment in previous role/sAbility to establish and maintain effective working relationships across all levels of seniority, both internally and externallyApplicationsThe Law Society of New South Wales is committed to building and maintaining a respectful and inclusive workplace, appointing the best person for the role and supporting diversity.Written applications should include a cover letter and brief resume.
